MEETING MINUTES
Rick Smith called the meeting to order at 5:00 p.m.
ROLL CALL:
Members of the Village Board present: Rick Smith, Sue Bird, Justeen Vollrath, Dan Lesniak, Rod Fisher, and Sidney Hallas.
Excused absent: Geri Kowalski
Also present: Krystal Bokelman, Village Clerk; Bruce Bierma, Administrator; Lisa Myles, Public Works Director/Zoning Administrator, and Shane VanderWaal, Attorney.
CONSIDERATION OF MOTION TO CONVENE INTO CLOSED SESSION PURSUANT TO SECTION 19.85(1)(G), WIS. STATS., TO CONFER WITH LEGAL COUNSEL FOR THE GOVERNMENTAL BODY WHO IS RENDERING ORAL OR WRITTEN ADVICE CONCERNING STRATEGY TO BE ADOPTED BY THE BODY WITH RESPECT TO LITIGATION IN WHICH IT IS OR IS LIKELY TO BECOME INVOLVED – G3 PROPERTIES LLC V VILLAGE OF KRONENWETTER AND TO CONSIDER THE CONFLICT OF INTEREST CONSENT TO ALLOW PIETZ, VANDERWAAL, STACKER & ROTTIER, S.C. TO REPRESENT SCHNEIDER CONSULTANTS, INC. IN MARATHON COUNTY CASE NO. 07-CV-976:
Sue Bird made a Motion to convene into closed session. Motion seconded by Justeen Vollrath. Roll Call: Smith-yes, Vollrath-yes, Fisher-yes, Lesniak-yes, Bird-yes, Hallas-yes. Motion approved.
MOTION TO RECONVENE INTO OPEN SESSION:
Sue Bird made a Motion to reconvene into open session. Sue Bird Motion seconded by Dan Lesniak. Roll Call: Smith-yes, Vollrath-yes, Fisher-yes, Lesniak-yes, Bird-yes, Hallas-yes. Motion approved.
DISCUSSION AND ACTION ON APPROVING CONFLICT OF INTEREST CONSENT TO ALLOW PIETZ, VANDERWAAL, STACKER & ROTTIER, S.C.’S TO REPRESENT SCHNEIDER CONSULTANTS, INC. IN MARATHON COUNTY CASE NO. 07-CV-976 – G3 PROPERTIES, LLC:
Sue Bird made a Motion to approve the Conflict of Interest Consent to allow Pietz, VanderWaal, Stacker & Rottier, S.C.’s to represent Schneider Consultants, Inc. in Marathon County Case No.: 07-CV-976 – G3 Properties, LLC.
Motion seconded by Sid Hallas.
Discussion: Justeen Vollrath suggested that there be an amendment written in that Dick Schneider, Schneider Consultants, SCI, will be paying 50% of attorneys fees, and each party is responsibility for one-half of attorney’s fees in this lawsuit effective March 12, 2008.
Sue Bird and Sid Hallas agreed with this amendment.
Roll Call: Smith-yes, Vollrath-yes, Fisher-yes, Lesniak-yes, Bird-yes, Hallas-yes. Motion approved.
ADJOURNMENT:
Sid Hallas made a Motion to adjourn, seconded by Sue Bird. All members in favor of Motion by voice vote. Motion approved.
